1. Scope and Service

1.1. The Permanent Show (TPS) is a website operated by HENDRIX DESIGN SAGL (Lugano, Switzerland). It provides an online platform to connect Artists (Users) with professional Visitors.
1.2. TPS provides promotional and advertising services through social networks, newsletters, and blogs.
1.3. TPS does not own the Designs. Any sale transaction is strictly between the User and the Visitor. TPS does not act as a seller or manufacturer.

2. Content and Intellectual Property

2.1. Ownership: The copyrights of all Designs remain with the Artist. TPS does not acquire any copyright over the uploaded works.
2.2. User Responsibility: By uploading content, the User warrants they own all necessary rights and that the content does not infringe on third-party rights.
2.3. Trademarks: TPS logos and domain names are the exclusive property of HENDRIX DESIGN SAGL.

3. Subscriptions and Fees

3.1. Access: To use the professional services, Artists must pay a subscription fee.
3.2. Current Rate: The standard fee is 1.200,00€ per year (or as specified in the pricing plans). TPS reserves the right to update rates periodically.

4. Account Security

4.1. Account credentials are strictly personal. Users are responsible for maintaining the confidentiality of their passwords.
4.2. TPS reserves the right to suspend accounts that breach these Terms.

5. Social Media Promotion

5.1. By using the Service, the User authorizes TPS to publish previews of their Designs on Instagram, Facebook, LinkedIn, Pinterest, and other digital channels for promotional purposes.

6. Governing Law and Jurisdiction

6.1. These Terms are governed by the Laws of Switzerland.
6.2. In case of any dispute, the Court of Lugano (Switzerland) shall have exclusive jurisdiction.
